We know that this legal jargon is not fun to read, but at the end of the day our Terms of Use defines our relationship with you.

Terms
  • All Dots services that facilitate applications for employment are free of charge.
  • Certain ancillary products and services may attract a transaction fee that is payable at the execution of the transaction.
  • Your telephone or Cellular Service Provider will charge all telephone calls that you make to Dots' telephony based facilities at their normal rates.
  • Your telephone or Cellular Service Provider will charge all data that you use to access the Dots app
Conditions
  • You indemnify Dots against all claims, actions, suits, liabilities, costs and expenses incurred on any account as a result of the listing or intended listing of any resumé by you on www.dots.za.com, or any related site.
  • Dots makes every effort to ensure that Applicant Data is treated in the strictest confidence, however, you will not hold Dots responsible if your resumé was unlawfully copied from the Dots website through nefarious means and/or distributed without consent.
  • Access to the candidate resumé database is available only to Dots recruitment agency clients who have been approved for resumé search capabilities and whom Dots has issued with privileged access codes to search the Dots database. Such Dots clients may access the candidate resumé database solely for the purpose of identifying candidates whose work preferences for location, category, industry and occupation match the clients‘ current vacancy advertisements with Dots While Dots will make every effort to ensure that Dots clients adhere to this undertaking, you herewith indemnify Dots against wrongful conduct, of any kind, by Dots recruitment agency clients.
  • While Dots will implement precautionary measures to ensure that the Dots website is free from viruses, Dots cannot and does not guarantee or warrant that files available for downloading through the site or delivered via electronic mail through the site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient protective software on your system that will satisfy your particular data security requirements and for maintaining a means external to your workstation for the reconstruction of any lost data.
  • You agree to take precautionary measures to ensure that your resumé on Dots is free from viruses or other destructive code.
  • Dots reserves the right to either reject or remove any resumé from its site(s) for any reason whatsoever.
  • You agree to present yourself truthfully in your resumés on Dots
  • Dots makes every effort to deliver applications to vacancies in the shortest possible time. You will however not hold Dots liable for any loss or damage as a result of any failure or delay in the delivery of an application for employment to an advertiser.
  • You agree, at all times, to deal with any information or products provided by Dots in a manner which abides by all applicable laws of South Africa, or of any other relevant jurisdiction (including, without limitation, privacy and copyright laws).
  • To the fullest extent permitted by law, Dots and its associates exclude all liability for any loss or damage (including indirect, special or consequential loss or damage) arising from the use of, or reliance on any services provided by Dots or its associates. Dots and its associates at all times limit their liability to the re-supply, where possible, of services not properly rendered; and where the re-supply of the service is not possible, to the refund of moneys paid for such services. Dots will not be liable under this paragraph where the failure to render services properly is attributable partially or wholly to your actions or omissions.
  • You agree to keep Dots and its associates fully indemnified against any actual or contingent liabilities incurred in relation to any actions or claims brought by any person against Dots as a result of an actual or alleged breach by you of any law, or such other actions or claims brought in relation to the provision of services by Dots to you.
  • You may not assign or transfer your rights and obligations to any other person without Dots'' prior written approval (which will not be unreasonably withheld).
  • This agreement is governed by the laws of South Africa. You irrevocably and unconditionally submit to the exclusive jurisdiction of the Courts of South Africa, and waive any objection to legal action being brought in those Courts on the grounds of venue or inconvenient forum.
  • Dots retains all intellectual property rights contained in the data stored on Dots and services provided by Dots, and you agree not to infringe any of Dots' rights without Dots' prior written consent. This includes the use of public domain information represented on Dots
  • You agree not to use the Dots infrastructure or technology to market any service to Dots
TERMS OF USE - ADVERTISERS
The Services

Dots provides facilities for recruiters to place advertisements pertaining to employment vacancies on the Dots Website. All advertisements are linked to a vacancy category and job title selected by the advertiser.

  • All advertisements placed will remain visible on Dots and its partner websites for a period determined by the advertiser. In the case of ad hoc advertisements, the maximum advertising period is 30 days.
  • Dots provides search services to allow applicants to view the vacancies. These include hierarchical, text search and any other search facilities.
  • When applicants register with Dots, the Dots system records their preferences. This information is used to generate notifications to applicants of positions that may suit them. Advertiser vacancy advertisements will be linked to the criteria that are used to generate notifications, which means that Dots will actively market vacancies to selected applicants.
Terms
  • Prices set by Dots (Pty) Ltd may vary without notice.
  • All amounts owing to Dots must be paid within 14 days of the date of invoice. Dots may charge interest on late payment in accordance with the prevailing Bank prime overdraft rate.
  • Advertisers must pay the amount of all invoices in full, notwithstanding any errors or omissions in any advertisement, into the Dots bank account, free of deduction or set off:

  • The prices listed on this site are valid from 1 June 2016 and exclude VAT.
Conditions
  • It is the responsibility of advertisers to ensure they comply with the Labour Relations Act and any other anti-discrimination legislation applicable in the Republic of South Africa. This is relevant to the creation of vacancy advertisements on Dots using the standard template to create advertisement Dots will not accept advertisements that appear to be contrary to law.
  • The advertiser indemnifies Dots against all claims, actions, suits, liabilities, costs and expenses incurred on any account by Dots as a result of the listing or intended listing of any advertisement by that advertiser on www.dots.za.com, or any related site.
  • Dots shall use reasonable endeavours to keep the vacancy advertisements available at all times. However, the advertiser agrees that Dots shall not be liable to the advertiser or any other person whatsoever in respect of any loss or damages caused by or arising from the unavailability of, or any interruption in the display of the advertisements for any reason whatsoever.
  • Dots shall use their best endeavours to notify the advertiser of any maintenance and repairs which may result in the advertisements being unavailable, but do not warrant that such notice will be given in advance.
  • Dots will do everything in its power to ensure that the Dots server is free from viruses or other destructive software, by employing industry standard virus protection and firewalling technology. Dots cannot and does not, however, guarantee or warrant that files available for downloading through the site or delivered via electronic mail through the site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. Advertisers are responsible for implementing sufficient procedures and checkpoints to satisfy their particular security requirements and output, and for maintaining external means for the reconstruction of any lost data.
  • Advertisers must make every effort to avoid errors in advertisements. Dots accepts no responsibility or liability for any errors and requires that advertisers check their advertisements for errors as soon as they are placed on the site(s). Any errors may be edited immediately.
  • Dots reserves the right to either reject or remove any advertisement from its site(s) for any reason whatsoever.
  • Dots makes every effort to publish advertisements in the shortest possible time. Dots is not liable for any loss or damage incurred by an advertiser as a result of any failure or delay in the listing an advertisement on Dots or its partner websites.
  • The Advertiser agrees at all times to deal with any information or products provided by Dots in a manner which abides by all applicable laws of South Africa, or of any other relevant jurisdiction (including, without limitation, privacy and copyright laws).
  • To the fullest extent permitted by law, Dots and its associates exclude all liability for any loss or damage (including indirect, special or consequential loss or damage) arising from the use of, or reliance on any services provided by Dots or its associates. Dots and its associates at all times limit their liability to the re-supply, where possible, of services not properly rendered; and where the re-supply of the service is not possible, to the refund of moneys paid for such services. Dots will not be liable under this paragraph where the failure to render services properly is attributable partially or wholly to the advertiser’s actions or omissions.
  • The Advertiser agrees to keep Dots and its associates fully indemnified against any actual or contingent liabilities incurred in relation to any actions or claims brought by any person against Dots as a result of an actual or alleged breach by him/her of any law, or such other actions or claims brought in relation to the provision of services by Dots on behalf of the Advertiser.
  • The Advertiser may not assign or transfer your rights and obligations to any other person without Dots' prior written approval (which will not be unreasonably withheld). If the Advertiser is a company, any change in the effective control of its ownership shall be deemed an assignment for the purpose of this clause.
  • This agreement is governed by the laws of South Africa. The Advertiser irrevocably and unconditionally submit to the exclusive jurisdiction of the Courts of South Africa, and waive any objection to legal action being brought in those Courts on the grounds of venue or inconvenient forum.
  • Dots retains all intellectual property rights contained in any of the data gathered as well as goods and services provided to the Advertiser by Dots, and the Advertiser agrees not to infringe any of Dots' rights without Dots' prior written consent.
  • Dots shall not divulge any personal information obtained from the advertiser to any third parties unless:
    • The advertiser has consented to any disclosure of such personal information to be made to any third party;
    • Any disclosure of such personal information is to be made by Dots to any of their employees or agents for the purpose of rendering the services to the advertiser;
    • Any law or order of court to disclose such personal information compels Dots
    • Any personal information supplied by the advertiser to Dots shall be securely stored by Dots
  • Whilst Dots shall endeavour to protect the advertiser from disclosure to any other party concerning the information furnished in this agreement, Dots shall nonetheless not be liable for damages in any manner whatsoever to the advertiser should such information become known to any other party, provided that such endeavour shall not apply in regard to any information which is publicly available from sources other than the parties.
Candidate CV database
  • Access to the candidate CV database is available only to Dots clients who have been approved for CV search capabilities.
  • Dots clients may access the candidate CV database solely for the purpose of recruitment.
  • Dots clients may not use the candidate CV database for any other purpose including, but not limited to, collecting and storing candidate contact information and other data.
  • Dots clients are required to be bound by the applicable South African laws, binding schemes or contracts that uphold privacy principles. Organisations, which are not bound by substantially similar principles, will be held to the rules described by the Information Technology Association of South Africa’s Code of Conduct.
  • All data stored on the Dots database is copyright protected and is Dots intellectual property.
The Entire Agreement

This agreement constitutes the whole agreement between the parties relating to the subject matter hereof. No amendment or consensual cancellation of this agreement or any provision or term thereof shall be binding unless recorded in a written document signed by the parties.

TERMS OF USE - REFCHECK
Information required
  • Supply all minimum required Information as requested by DOTS RECRUIT.
  • A signed indemnity form must accompany each applicant’s request. (A DOTS RECRUIT consent form will be sent to you upon registration of the project).
  • The specified information will be formatted electronically (Microsoft Excel Format). An example will be provided upon acceptance of the quote (If the information is not supplied in this format and has to be manually captured by DOTS RECRUIT, an additional charge per credential will be applicable).
  • Copies of certificates of qualifications and consent forms must accompany the electronic information.
  • Short courses (i.e. less than 1 year curriculum). DOTS RECRUIT will attempt to verify these qualifications, but cannot guarantee turnaround times. Neither can DOTS RECRUIT guarantee that a result will be obtained.
  • Note that even in the event that no result can be obtained, you will be invoiced the full amount as quoted.
  • The Turnaround Times of all verification types are measured between the date and time that the last required information item or applicable form has been received by DOTS RECRUIT, and the date and time that the result is released.
  • If all information is not provided, or copies of certificates are not supplied, a Request for Additional Information is generated, and the Service Expectation is void.
  • The Candidate’s student number must be supplied for the University of the North.
Terms and Conditions
  1. Charges for Additional Information:
    1. Additional Information requests are generated as a result of the following:
      1. Copies of Certificates were not received.
      2. Personal or Type Information on the PCV form or electronic request is incomplete or incorrect.
    2. R2.00 (Two Rand) per request.
  2. Charges for Cancellations:
    1. Cancellations are applicable when additional information was not received within 24 hours of the request, or if cancelled at client’s request before processing.
    2. R5.00 (Five Rand) per cancellation.
  3. Specific Additional Charges:
    1. In the event of a Sole or Government Gazetted supplier to DOTS RECRUIT advising of an extraordinary price increase, DOTS RECRUIT will notify you and provide the written proof of such a price increase.
    2. Additional supplier fees will have a direct impact on the above pricing and will be for the cost the client. DOTS RECRUIT commits to supplying 1 (one) calendar months’ notice before implementing any changes to the pricing structure.
    3. Upon registration DOTS RECRUIT will provide a detailed list of suppliers, nationally and internationally, where additional fees for verifications apply. DOTS RECRUIT will 1st inform you and request permission to continue with such verifications.
    4. Cost of R20.00 will be charged for Credit verifications done with a passport number instead of the required a South African ID number. 4 All prices exclude VAT.
  4. Payment terms are strictly 30 days. If payment is not received within 30 days, and no prior arrangements have been made for late payments, the client’s profile gets suspended until payment is received.
  5. As soon as your signed project quotation is received, a contractual agreement between DOTS RECRUIT and your Company will be deemed effective.
  6. This quotation is valid for a period of 14 (fourteen) days after the quotation date. The quotation will be considered accepted on receipt of a completed client registration form within this valid period.
  7. After registration this quotation will only be valid for 6 (Six) months (from the date of this quotation) for the specific project information as indicated. While DOTS RECRUIT endeavours to make every effort to maintain the prices as stipulated above, circumstances beyond the control of the company, including but not limited to Supplier increases, may force client price increases.
Consent and Indemnity

Credential Verification checks cannot be performed on an individual without a signed consent/indemnity form.

Several items of legislation, including but not limited to the PoPI Act and the Constitution protects the rights and privacy of individuals, and govern the Background Screening Process.

To this end, DOTS RECRUIT has developed a standard Personal Credential Disclosure Form (often referred to as the PCV form or DOTS RECRUIT Consent Form) that must be completed before DOTS RECRUIT can begin the verification process.

Consent and Indemnity
  1. Service Expectations are subject to change based on several conditions (end of year, Easter holidays, graduation ceremonies, supplier issues, etc.), and as such are NOT considered to be contractual agreements. Any change in Service Expectation will be communicated as soon as DOTS RECRUIT becomes aware of them.
  2. The following information verification suppliers in particular provide for limited Service Expectation
    1. MERSETA – No Expectation
    2. University of Cambridge – Expect delivery within 30 business days.
    3. Edexcel – Expect delivery within 28 business days.
  3. Problematic South African ID numbers are tested via a variety of information verification suppliers, and delivery can be expected after 5 business days.
  4. There are no Service Expectations in the event of a failure of either Eskom or Telkom, the South African power and telecommunications utilities respectively.
